This is a binding Agreement. Read all the terms. Your use or access of theSCRUBDNS.COM website or any associated websites, including those pages or websites used for providing DNS services indicates Your acceptance of the terms and conditions of this Terms of Use Agreement. If You are unwilling to accept the terms and conditions of this agreement, You should discontinue Your use or access of any of these websites. In consideration of the mutual premises and covenants contained herein, the receipt and sufficiency of which are hereby acknowledged, You agree to the following:

MODIFICATION TO AGREEMENT
Except as otherwise provided in this Agreement, You agree, during the term of this Agreement, that we may revise the terms and conditions of this Agreement and/or change the services provided under this Agreement at any time. Any such revision or change will be binding and effective ten (10) calendar days after the revised Agreement or change to the service(s) is posted on the SCRUBDNS.COM website. You agree to periodically review our website, including the current version of this Agreement available on our website, to be aware of any such revisions. If You do not agree with any revision to the Agreement or change to the services, You may terminate this Agreement at any time. Any fees paid by You prior to termination of Your Agreement with us are nonrefundable, but You will not incur any additional fees. By continuing to use our services ten (10) calendar days after any revision to this Agreement or change in service(s) is posted on our website, You agree to abide by and be bound by any such revisions or changes. We are not bound by and You may not rely on any representation concerning this Agreement or our services made by: (i)any agent, representative or employee of any third party that You may use to apply for our services; or (ii) information posted on our Web site of a general informational nature. No employee, contractor, agent or representative of SCRUBDNS.COM or any partner of SCRUBDNS.COM is authorized to alter or amend the terms and conditions of this Agreement.

YOU MAY NOT:
(i) translate, reverse engineer, decompile, or disassemble the Product except to the extent the foregoing restriction is, by operation of applicable law, prohibited or of no effect; (ii) (ii) rent, lease, assign, sell, sublicense, lend or transfer the Product

NO UNLAWFUL CONDUCT OR IMPROPER USE
You agree not to use them for any purpose that is unlawful or prohibited by these terms and conditions, and You agree to comply with any applicable local, state, federal and international laws, government rules or requirements.

ACCOUNT SECURITY
You agree You are entirely responsible for maintaining the confidentiality of Your customer information. You agree You are entirely responsible for any and all activities that occur under Your account. You agree to notify SCRUBDNS.COM immediately of any unauthorized use of Your account or any other breach of security. You agree SCRUBDNS.COM will not be liable for any loss that You may incur as a result of someone else using Your Account Access Information, either with or without Your knowledge. You further agree You could be held liable for losses incurred by SCRUBDNS.COM or another party due to someone else using Your Account Access Information. For security purposes, You should keep Account Access Information in a secure location and take precautions to prevent others from gaining access to Your Account Access Information. You agree that You will be responsible for all activity in Your account, whetherinitiated by You, or by others on Your behalf, or by any other means. SCRUBDNS.COM specifically disclaims liability for any activity in Your account, whether authorized by You or not.

INTELLECTUAL PROPERTY
You agree that SCRUBDNS.COM or its licensor holds all rights, title and interest in all Software and Services and all intellectual property, including other rights related to intangible property, unless otherwise indicated. You acknowledge that no title or interest in such Intellectual Property Rights is being transferred to You and You agree to make no claim of interest in any such Services or Software. You understand and agree that all content and materials contained in this Agreement, other policies, SCRUBDNS.COM, and any affiliated Web sites, are protected by the various copyright, patent, trademark, service mark and trade secret laws of the United States, as well as any other applicable proprietary rights and laws, and that SCRUBDNS.COM or its licensor expressly reserves its rights in and to all such content and materials. You further understand and agree that You are prohibited from using, in any manner whatsoever, any of the content or materials described above without the express written permission of SCRUBDNS.COM or its licensor. No license or right under any copyright, patent, trademark, service mark or other proprietary right or license is granted to You or conferred upon You by this Agreement or otherwise.

LIMITATION OF LIABILITY
To the extent permitted at law, SCRUBDNS.COM and its partners and contractors will not be liable for any direct, indirect, incidental, special or consequential damages resulting from Your use or inability to use any of the SCRUBDNS.COM services or for the cost of procurement of substitute services. We disclaim any and all loss or liability resulting from, but not limited to: (i)any third party claims arising from or based on Your use of our services; (ii) access delays or access interruptions; (iii) data non-delivery or data mis-delivery; (iv) acts of God; (v) the unauthorized use or misuse of Your Account name or password; (vi) errors, omissions, or misstatements in any and all information or service(s) provided under this Agreement; (vii) the deletion of or failure to store data of any kind; (viii) the development or interruption of Your website; or (x) our processing of Your application for our services, our processing of any authorized modification to Your record or Your agents failure to pay any fees, our fees or re-registration fees. You agree that our entire liability, and Your exclusive remedy, with respect to any SCRUBDNS.COM service(s) provided under this Agreement and/or for any breach of this Agreement is solely limited to the amount You paid for such service(s).

INDEMNIFICATION
You agree to release, indemnify, and hold SCRUBDNS.COM, our partners, contractors, agents, employees, officers, directors, shareholders, affiliates and assigns harmless from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and expenses, relating to or arising from the SCRUBDNS.COM services provided hereunder. When we are threatened with suit or sued by a third party, we may seek written assurances from You concerning Your promise to indemnify us; Your failure to provide those assurances may be considered by us to be a material breach of this Agreement. In addition, in the event we are made a party to any claim, suit or action by You which is unsuccessful or by a third party in each case relating to or arising from the SCRUBDNS.COM services provided hereunder, You will reimburse us, at a reasonable rate, for all personnel time and expenses expended by us in response to such claim, suit or action including without limitation, all attorney fees and expenses incurred by us with respect to such response.

JURISDICTION
This Agreement is governed by the laws of the State of Utah, U.S.A. You hereby consent to the exclusive jurisdiction and venue of courts sitting in Utah, County of Salt Lake and/or District of Utah in all disputes arising out of or relating to the use of the websites.

SEVERABILITY
You agree that the terms of this Agreement are severable. If any part of this Agreement is determined to be unenforceable or invalid, that part of the agreement will be interpreted in accordance with applicable law as closely as possible, in line with the original intention of both parties to the Agreement. The remaining terms and conditions of the Agreement will remain in full force and effect.
